Bloom - Terms of Use

Game: The product or app or interactive media governed by this agreement, which in this case is the game titled 'Bloom'.

IP Right: Any intellectual property right, including but not limited to any copyright, trademark, patent, trade secret, industrial design right, database right, level design software, idea, concept, method, invention, content, item, or combinations thereof.

Service or Services: Any game, website, app, software and other related Services provided by Lucid Labs and its affiliates.

Terms of Use or Terms: The terms and conditions of this agreement.

User Generated Content or User Content UGC: Content that has been created and posted by a user in the Game, using the tools provided inside the Game.

Lucid Labs assumes no responsibility for the conduct of any user submitting any content created by users ("User Content"), and assumes no responsibility for monitoring the Service for inappropriate content or conduct. We are unable to pre-screen or monitor all User Content and we will not do so. Your use of the Service is at your own risk.

When you transmit or upload User Content, you agree to abide by the following rules:

• All content will be accurate.
• All content will never portray itself as content created or endorsed by Lucid Labs.
• All content will be free of any infringing material.
• All content will not be in violation of any law, contractual restrictions, or other parties' rights.
• All content will be free of spam, commercial solicitation, chain letters, and mass communications.
• All content will be free of nudity, political messaging, profanity, voilence and gore.
• User Content may be removed or moderated by Lucid Labs as they see fit, without any prior notice.

When you interact with User Content, you acknowledge:

• The User Content is not endorsed or promoted by Lucid Labs.
• All content is created and uploaded by users playing the Game.
• User Content may contain inappropriate messaging, symbols, layouts, diagrams.
• User Content may contain certain information not suitable for all ages.
• User Content may not provide an ideal gaming experience.

Reporting objectionable User Generated Content

If you want to report a UGC, you can do so in the game in the following ways:

• In the Pause Menu of a UGC level.
• In the 'Level Complete' screen of a UGC level.

You hereby grant Lucid Labs an irrevocable, perpetual, transferable, fully paid, royalty-free, worldwide license (including the right to sublicense and assign to third party) and right to copy, reproduce, fix, adapt, modify, create derivative works from, manufacture, commercialize, publish, distribute, sell, license, sublicense, transfer, lease, transmit, publicly display, publicly perform, or provide access to electronically, broadcast, communicate to the public by telecommunication, display, perform, enter into computer memory, and use and practice, in any way, your User Content as well as all modified and derivative works thereof in connection with our provision of the Service, including marketing and promotions of the Service. You also hereby grant to Lucid Labs the right to authorize others to exercise any of the rights granted to Lucid Labs under these Terms of Use.

You further hereby grant to Lucid Labs the unconditional, irrevocable right to use and exploit your name, likeness and any other information or material included in any User Content and in connection with any User Content, without any obligation to you. Except as prohibited by law, you waive any rights of attribution and/or any moral rights you may have in your User Content, regardless of whether your User Content is altered or changed in any manner. You also grant Lucid Labs perpetual ownership rights related to your User Content.

You acknowledge that Lucid Labs may in its sole and absolute discretion provide subsequent versions, enhancements, modifications, upgrades or patches related to any part of the Services. You acknowledge that admission to or use of the Services may be interrupted for reasons within or beyond the control of Lucid Labs, and that Lucid Labs cannot and does not guarantee you will be able to use the Services whenever you wish to do so.

Lucid Labs has absolute and sole discretion to immediately terminate or restrict access to the Services, or any portion of the Services, including any and all Accounts, at any time, for any reason, without Notice and without liability to you.

Lucid Labs might not offer the Services in all countries or geographic locations.

You are solely responsible for any internet connection and mobile fees that you may incur as a result of using our Services.

Unless modified or amended by Lucid Labs, this agreement and its provisions shall remain in effect. Termination of any license granted by Lucid Labs under this agreement does not affect any other provisions of this agreement.

You agree to defend, indemnify and hold harmless Lucid Labs, any third-parties under agreement with Lucid Labs, any parent, subsidiary or affiliate of Lucid Labs, and any employee, agent, supplier, licensee, customer, distributor, shareholder, director or officer of any of the foregoing, as well as any person using the Services and any person or entity that becomes aware of your use of the Services at any time, with respect to any and all claims, liabilities, injuries, damages, losses or expenses (including but not limited to attorney’s fees and costs) that arise under, from or in any way, directly or indirectly, relate to:

• Your failure to comply with any provision of this agreement;
• Your use of the Services, including but not limited to economic, physical, emotional, psychological or privacy related considerations; and
• Your actions to knowingly affect the Services via any bloatware, malware, computer virus, worm, Trojan horse, spyware, adware, crimeware, scareware, rootkit or any other program installed in a way that executable code of any program is scheduled to utilize or utilizes processor cycles during periods of time when such program is not directly or indirectly being used.

You acknowledge, and further agree, that Lucid Labs has no obligation to defend, indemnify or hold harmless you in any way related to this agreement including, but not limited to, your use of the Services, use of the Services by any person, or any connection between the foregoing and any other person or entity that becomes aware of your use of the Services at any time.

As our Services, our business, and applicable laws change, we may change our Terms of Use from time to time without any prior notice. These Terms of Use are effective as of 12-Jun-2022. These Terms of Use was last updated on 28-Jun-2023.

Informal Resolution. With respect to the resolution of any controversy related to this agreement (hereinafter "Dispute") you agree to try to resolve any Dispute informally ("Informal Dispute Resolution") for at least thirty (30) days before initiating any arbitration or other proceeding, including any legal proceeding in court or before an administrative agency.
